This Privacy Policy explains how Gilda After Dark, LLC (“Gilda After Dark,” “we,” “us”) collects, uses, shares, and protects personal information when you use the Gilda After Dark marketplace (the “Service”). By using the Service you agree to the practices described here.

We collect the following categories of information:

• Account information — email address, display name, hashed password (or federated identifier when signing in with a third-party provider), and profile details you choose to provide.
• Seller information — shop name, shop description, banner and avatar images, payout-related information (when payouts are enabled), and, at the Seller’s option, encrypted credentials for connected print-on-demand providers.
• Listing and order information — content of listings, inventory counts, buyer and seller actions on the order, and, for physical goods, shipping addresses.
• Communications — the content of in-platform messages and dispute threads.
• Technical information — IP address, browser type, device information, and basic log data necessary to operate and secure the Service.
• Age-gate acknowledgment — a client-side record that you confirmed you are 18 or older.

We use personal information to:

• Provide and operate the Service, including account access, listings, messaging, orders, and dispute resolution.
• Communicate with you about your account, orders, disputes, and policy changes.
• Detect, prevent, and investigate fraud, abuse, and violations of our policies or applicable law.
• Comply with legal obligations and respond to lawful requests.
• Improve and secure the Service.

We share personal information only as described below. We do not sell personal information.

• With Sellers and buyers — information necessary to complete a transaction (for example, shipping address to the Seller).
• With Subprocessors — the third-party service providers listed in our Third Parties policy, each of which receives only the data necessary to perform its function.
• For legal reasons — where required by law, subpoena, court order, or to protect the rights, property, or safety of Gilda After Dark, its users, or the public.
• In business transfers — if Gilda After Dark, LLC is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to standard confidentiality protections.

We use cookies and browser storage strictly for operating the Service, including keeping you signed in, remembering your theme preference, and recording your age-gate acknowledgment. We do not currently use third-party advertising or cross-site tracking cookies.

We retain personal information for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account we delete or anonymize personal information within a reasonable period, except where retention is required by law or necessary to complete a pending transaction or dispute.

Depending on your jurisdiction you may have rights to access, correct, export, or delete personal information we hold about you, and to object to or restrict certain processing. You can exercise most rights directly through your account settings or by contacting legal@gildaafterdark.com. We will respond within the time period required by applicable law.

The Service is intended solely for users aged 18 or older. We do not knowingly collect personal information from anyone under 13, and portions of the Service require the user to affirm they are 18 or older. If we learn that we have collected information from a child under 13, we will delete it.

We use administrative, technical, and physical safeguards designed to protect personal information, including row-level security on marketplace data, encryption of connected Seller credentials at rest, and encrypted transport. No system is perfectly secure and we cannot guarantee absolute security.

Gilda After Dark, LLC operates from the United States. If you access the Service from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States and other jurisdictions where our Subprocessors operate. Where required, we rely on appropriate legal mechanisms for cross-border transfers.

We may update this Privacy Policy from time to time. Material changes will be reflected by a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
