Sellers Policy

This Sellers Policy applies to any user who lists or offers goods or services for sale on Gilda After Dark (a “Seller”). By opening a shop, listing an item, or otherwise using seller features of the Service, you agree to this Policy in addition to any other policies referenced on the site.

You must be at least 18 years of age, legally able to enter into binding contracts, and authorized to sell the goods you list. You are responsible for the accuracy of the information you provide during onboarding, including your shop name, description, and any business or tax information.

Sellers pay: (a) a listing fee of USD $0.10 per listing at the time the listing is created or renewed; and (b) a 10% commission on the gross sale price of each completed order (excluding shipping and taxes unless required by law). Payment-processor fees imposed by third-party providers are separate and are passed through as disclosed at checkout. Fees are non-refundable except where required by law or expressly stated on the Service.

You are solely responsible for the accuracy of every listing, including title, description, images, price, inventory count, shipping terms, and any variants. You must have the legal right to sell each item and to use each image or asset in the listing. You agree to keep inventory counts current and to promptly cancel or refund orders you cannot fulfill.

Sellers may not list, offer, or sell:

• Illegal goods or services, or goods restricted from sale in the buyer’s or Seller’s jurisdiction.
• Firearms, ammunition, explosives, or regulated weapons.
• Controlled substances, prescription drugs, or drug paraphernalia.
• Content depicting minors in a sexual or exploitative manner. This is a permanent, no-exceptions prohibition.
• Non-consensual intimate imagery or content produced without the depicted person’s verifiable consent.
• Content that infringes another person’s intellectual-property or publicity rights.
• Hate speech, incitement to violence, or content targeting a person or group based on protected characteristics.
• Counterfeit, stolen, or recalled items.
• Human remains, hazardous materials, or live animals.

Sellers may not manipulate reviews, fabricate orders, harass buyers, solicit off-platform transactions to avoid fees, or interfere with the operation of the Service.

Gilda After Dark permits legally allowable mature and adult content from Sellers who comply with these requirements: (a) accurate category and tagging so the item appears behind the age gate; (b) images and descriptions that do not violate the prohibitions above; (c) compliance with all applicable record-keeping and disclosure laws for adult content in the Seller’s jurisdiction, including United States 18 U.S.C. § 2257 where applicable; and (d) verifiable consent from every identifiable person depicted. Gilda After Dark may remove content that in our judgment fails to meet these standards.

You retain ownership of the intellectual property in your listings. By listing on the Service, you grant Gilda After Dark, LLC a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and promote your listings and shop content for the purpose of operating and marketing the Service. If you believe content on the Service infringes your rights, contact legal@gildaafterdark.com with sufficient detail to identify the work and the allegedly infringing listing.

You are responsible for fulfilling every order you accept, including packaging, shipping, tracking (where available), customs disclosures, and any Seller-specific return process. Sellers who use integrated print-on-demand providers (currently Printful and Gelato) remain responsible for the accuracy of listings, the resulting products, and communications with buyers. Communication with buyers must occur through the platform messaging feature. Do not solicit off-platform contact to complete a transaction outside the Service. Message content is subject to the same prohibitions as listings.

Sellers agree to cooperate in good faith with our dispute process (see Buyers Policy), respond to buyer messages promptly, and provide evidence reasonably requested by Gilda After Dark. Chargebacks initiated by a buyer’s bank are handled through the payment processor and may result in withheld funds.

You are solely responsible for determining, collecting, reporting, and remitting all taxes associated with your sales, including income tax and any sales, use, VAT, GST, or similar taxes. Where required by law, Gilda After Dark or its payment provider may collect and remit taxes on your behalf and issue tax forms.

Payouts to Sellers become available once the marketplace’s production payments integration is enabled. Until then, no live payouts occur through the Service. Payout timing, minimum thresholds, and reserve policies will be disclosed at that time.

We may remove listings, close shops, or terminate accounts that violate this Policy, applicable law, or where continued access presents risk to the Service, its buyers, or third parties. You may close your shop at any time; obligations for pending orders remain in effect until those orders are fulfilled or refunded.

We may update this Policy from time to time. Material changes will be reflected by a new “Last updated” date. Continued use of Seller features after changes take effect constitutes acceptance of the revised Policy.
